Terms & Conditions

By accessing and using the services provided by FAcode Software Solution Pvt Ltd ("FAcode," "we," "us," or "our"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

FAcode provides software development services including but not limited to:

• Custom website development
• Mobile application development (iOS & Android)
• E-commerce solutions
• AI and machine learning integrations
• Cloud deployment and infrastructure
• Maintenance and technical support
• Digital transformation consulting

As a client, you agree to:

• Provide accurate and complete information required for project execution
• Respond to requests for feedback and approvals in a timely manner
• Make payments according to the agreed schedule
• Ensure you have the rights to all content, images, and materials provided to us
• Comply with all applicable laws and regulations

• Payment schedules are defined in individual project agreements
• Typical payment structure: 30-40% upfront, 30-40% during milestones, 20-30% upon completion
• Late payments may result in project delays or suspension of services
• All prices are in Indian Rupees (INR) unless otherwise specified
• Taxes and transaction fees are additional and will be specified in the invoice

Upon full payment, all custom code and designs created specifically for your project will be transferred to you. However, we retain the right to:

• Use general methodologies, frameworks, and tools developed by us
• Display completed projects in our portfolio (unless covered by NDA)
• Reuse non-client-specific code components in future projects

We respect the confidentiality of your project information. All sensitive information shared during the project will be kept confidential and will not be disclosed to third parties without your consent, except as required by law.

We warrant that our services will be performed in a professional and workmanlike manner. However, we do not guarantee that our services will be uninterrupted, error-free, or meet all your requirements. We disclaim all other warranties, express or implied.

FAcode shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services. Our total liability shall not exceed the amount paid by you for the specific service.

Changes to the project scope after commencement may result in additional costs and timeline adjustments. All change requests will be documented and must be agreed upon in writing before implementation.

Either party may terminate the agreement with written notice. Upon termination:

• You will be billed for all work completed up to the termination date
• We will provide all completed work deliverables upon receipt of final payment
• Refunds, if any, will be processed as per the agreement terms

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
